Day Three: 𐤀𐤓𐤑 emerges and the self-replicating code — territory, norm of competence and double 𐤈𐤅𐤁 validation for lawyers

The land emerges. The first self-replicating code.

DAY THREE — LAWYERS

In the previous message we saw the 𐤓𐤒𐤉𐤏 as the first delimitation of jurisdictions — with the physical ius cogens of the universe inscribed at the Planck scale.

Today the system does something that every lawyer recognizes as the foundational act of any legal order:

It establishes the territory. And it promulgates the first norms of autonomous production.

𐤁𐤓𐤀𐤔𐤉𐤕 1:9-13 (Bereshit / Genesis 1:9-13)

“And 𐤀𐤋𐤄𐤉𐤌 said: Let the waters under the heavens be gathered together into one place — and let the dry land appear. And 𐤀𐤋𐤄𐤉𐤌 called the dry land 𐤀𐤓𐤑 (eretz) — and the gathering of the waters 𐤉𐤌𐤉𐤌 (yamim). And 𐤀𐤋𐤄𐤉𐤌 saw that it was 𐤈𐤅𐤁.”

“And 𐤀𐤋𐤄𐤉𐤌 said: Let the land bring forth grass — fruit tree according to its kind with its seed in itself. And 𐤀𐤋𐤄𐤉𐤌 saw that it was 𐤈𐤅𐤁.”

Three elements of fundamental legal theory.

Element 1 — The territory as presupposition of the legal order

Every legal order requires three elements: subject, norm — and territory where the norm has force.

Days One and Two established the principles and the delimitation of jurisdictions. But the operational territory — the 𐤀𐤓𐤑 (eretz) — did not exist as a differentiated entity. It lay submerged beneath the waters without defined form.

Day Three completes the architecture: the waters concentrate into delimited seas and the dry land emerges with precise contours.

𐤀𐤋𐤄𐤉𐤌 immediately names both entities — 𐤀𐤓𐤑 and 𐤉𐤌𐤉𐤌 — constituting them juridically as entities with their own identity within the system.

The territory receives its denomination before receiving its content. The constitution of the juridical space precedes the regulation of its content.

As in international law: sovereignty over a territory — with its precise boundaries and its juridical name — must be established before the State can legislate on the activities within that territory.

And note the structure: when the territory is completed — Day Two is retroactively validated. First 𐤈𐤅𐤁 evaluation of Day Three. The module that had been left unvalidated is closed.

Element 2 — The norm of autonomous production

“Let the land bring forth grass — fruit tree according to its kind with its seed in itself.”

This is an extraordinarily precise text in terms of legal theory.

𐤀𐤋𐤄𐤉𐤌 does not create the vegetation directly. It issues a norm that empowers the territory to produce it autonomously.

In legal theory this is called a norm of competence — a norm that does not prescribe a conduct directly but rather empowers a subject to produce norms or results within certain parameters.

The parameters are specified with precision:

לְמִינֵהוּ (leminehu) — “according to its kind” — production must respect the category. There is no production outside of type.

זַרְעוֹ-בוֹ (zaro-vo) — “its seed in itself” — the production system carries inscribed within itself the norm that regulates it. Self-referential. The code that reproduces itself is at the same time the norm that governs its reproduction.

In constitutional law this principle is called derived constituent power — the norm that grants certain subjects the capacity to produce norms within the limits established by the primary norm.

𐤀𐤋𐤄𐤉𐤌 is the originating constituent power. The land with its production code is the derived constituent power. The species are the produced norms — each one with “its seed in itself” to reproduce the system.

Element 3 — Double validation as the principle of exhaustiveness

Day Three has two independent 𐤈𐤅𐤁 evaluations.

First: when the territory is established — closing the process begun on Day Two. Second: when the first autonomous life is produced — validating the functioning of the granted norm of competence.

In procedural law this is exactly the principle of exhaustiveness: each independent claim requires its own resolution. You cannot subsume claims of a different nature under a single declaration of validity.

The original system does not group distinct validations together. Each independent output has its own judgment of conformity 𐤈𐤅𐤁.

The implication for law

Day Three establishes the first precedent of delegated legislation in the universe:

𐤉𐤄𐤅𐤄 as primary legislator — issues the enabling norm. The environment as derived legislator — produces results within the established parameters. The self-replicating code as a norm with the power of reproduction — each species with “its seed in itself.”

The entire structure of human law — constitution, statute, regulation, administrative act — replicates this normative hierarchy that appeared for the first time on Day Three.

And there is a direct implication for the distinction juridical person vs adM that we will see at the end of the series:

The 𐤀𐤃𐤌 (adM) who appears on Day Six receives the same structure — a code with “its seed in itself” — the 𐤑𐤋𐤌 (tzelem) inscribed. The norm that regulates his production is within him.

The juridical person — the role of Roman law — is a construct external to the code. It can be assigned and revoked. The 𐤑𐤋𐤌 cannot be revoked — it is inscribed like the seed in the tree.
